Before contracting any of the services we offer at articagency.com, it is essential that you read these conditions and the terms that apply to the provision of the services offered here.

These terms and conditions may be modified at any time. It is your responsibility to read them periodically, as the terms and conditions in force at the time of entering into each Contract (as defined below) or, failing that, at the time of using the website will be the ones applicable to you.

The services and products offered are available only to legal entities and individuals aged 18 or over.

Right of exclusion

Artic Agency reserves the right to deny or withdraw access to the website and the products offered without prior notice, at its own discretion or at the request of a third party, to those users who violate these terms of use.

Purchase process

The electronic contracting process will follow these steps:

After viewing a sales or service page, the user will proceed to select one of the existing options to acquire the corresponding service or product, clicking on the buttons enabled to begin the purchase process.

Once the chosen option has been selected, the user will fill in the requested information.

After filling in the details, you must accept the terms and conditions and enter your bank card number to proceed with payment through the Stripe gateway, which meets all security standards.

Once this step is completed, the user will receive an email with the purchase receipt, and can request the invoice later if necessary.

We recommend that you keep a copy of these terms and conditions at the time of purchase.

Prices and payment methods

The prices applicable to each product and/or service are those indicated on the website.

The final price will appear during the confirmation of your order.

Payment will be made in advance and services will be provided when this payment is confirmed.

Some services that are paid monthly are subscription services and a subscription will be generated with Stripe directly to the indicated card.

In some services, depending on the amount of the service, you will be given the option to split it into 2 or 3 payments.

Prices for services and products may change at any time at the sole and exclusive discretion of Artic Agency. Services do not offer price protection or refunds in the event of price reductions or promotional offers.

Intellectual and Industrial Property

Artic Agency owns all intellectual and industrial property rights to the elements and services appearing on this website. All rights reserved.

Any use not previously authorized by Artic Agency will be considered a serious infringement of intellectual and industrial property rights, and we reserve the right to take all civil and criminal actions available to us to safeguard our rights, under penalty of committing an offense against the intellectual property of art, as defined in Articles 270 et seq. of the Penal Code, with prison sentences of up to 4 years.

Arctic Agency acts as Authorized reseller of DonDominio (IP Corporate Solutions, SL), DonDominio is an ICANN-accredited registrar. Through this partnership, we offer domain registration, renewal, and management services to our clients. In accordance with DonDominio and ICANN requirements, we provide the following information:

Whois Privacy Policy

We do not use Whois Privacy or external proxy services at DonDominio. All data is managed in accordance with the regulations and tools that DonDominio makes available to its customers and resellers.

Right of withdrawal

The Client will not have the right of withdrawal once contracted for any of the web design services; however, if the work has not yet started, you can contact us at [email protected] to assess it.

In the event of a refund, it will be made using the same payment method used for the initial transaction.

Processing of personal data

In accordance with Organic Law 3/2018, of December 5, on the Protection of Personal Data and the guarantee of digital rights, the data will be processed by Artic Agency as “Clients and Suppliers” for purposes appropriate to the processing, which include:

The management of legal and economic relations between owner and clients.
Managing the service contract with the client.

To the extent authorized by the interested party; the user being responsible for their accuracy.

Unless expressly objected, the Client expressly consents to the processing of their personal data to send information of interest, news and offers about products and services through any means, including email.

You may exercise your rights of access, rectification, cancellation and opposition by sending an email to [email protected] along with legally valid proof, such as a photocopy of your ID card or equivalent, indicating "Data Protection" in the subject line.

These terms are subject to the Artic Agency privacy policy.

Causes of contract dissolution

The termination of the service contract may be initiated at any time by either party.

You are not bound by any minimum commitment period with Artic Agency if you are not satisfied with our service, unless explicitly stated in the subscription or deferred payment models.

We may terminate or suspend any or all of the contracted services immediately, without prior notice or liability, if you fail to comply with the conditions set forth herein.

The following shall be grounds for termination of contract:

  • The falsity, in whole or in part, of the data provided in the process of contracting any service.
  • Alter, circumvent, reverse engineer, decompile, disassemble or otherwise modify the security technology provided by Arctic Agency.
  • Also, cases of abuse of support services by requesting more hours than those established in the contract.
  • Non-payment for services or products.
  • Any breach established throughout the conditions.

Dissolution implies the loss of your rights over the contracted service and its immediate cessation.

European consumer regulations

The European Commission has created the first European platform for resolving disputes in e-commerce, under the latest consumer law. Artic Agency, as the operator of this online sales platform, is obligated to inform its customers about the existence of this online alternative dispute resolution platform.

Applicable law and jurisdiction

The relationship between Artic Agency and the Client will be governed by current regulations and any dispute will be submitted to the corresponding Courts and Tribunals, unless otherwise provided by applicable law.
